Canterbury Lifts Terms and Conditions


1. Introduction
These Terms and Conditions govern the provision of services by Canterbury
Lifts ("Company", "we", "us", or "our") to our clients ("Client", "you", or
"your"). By engaging our services, you agree to be bound by these Terms and
Conditions.

2. Services
2.1 Scope of Services: Canterbury Lifts provides lift installation,
maintenance, repair, and upgrade services. The specific services to be provided
will be detailed in the project agreement or service contract.
2.2 Changes to Services: Any changes to the scope of services must be
agreed upon in writing by both parties. Additional costs or time required for
changes will be reflected in an amended project agreement or service contract.

3. Quotations and Pricing
3.1 Quotations: All quotations provided by Canterbury Lifts are valid for 30
days from the date of issuance unless otherwise specified. Quotations are
based on the information provided by the Client and are subject to change if
the scope of work changes.
3.2 Pricing: Prices are inclusive of labour, materials, and any applicable taxes
unless otherwise specified. Additional charges may apply for work outside of
normal business hours, unforeseen complications, or changes requested by the
Client.

 

4. Payment Terms
4.1 Invoices: Invoices will be issued upon completion of the work or at agreed
milestones for longer projects.
4.2 Payment Due Date: Payment is due within 30 days from the date of the
invoice unless otherwise specified in the service contract.
4.3 Late Payments: Late payments may incur interest at a rate of 2% per
month. Canterbury Lifts reserves the right to suspend services if payments are
not received within the specified time frame. Late payments also requires pro
forma payments for all future works unless otherwise agreed.

5. Client Responsibilities
5.1 Site Access: The Client must provide safe and timely access to the site
where services are to be performed. Delays caused by lack of access may
result in additional charges.
5.2 Information and Cooperation: The Client must provide all necessary
information and cooperation to enable us to perform the services. This
includes, but is not limited to, site plans, specifications, and any relevant
health and safety information.
5.3 Site preparation: The Client must ensure all agreed works have been
carried out prior to the engineers visit. This may include but is not limited to,
power being live, area made safe/closed to public if required, lift area clean
and accessible in a ready state for works to commence.


6. Health and Safety
6.1 Compliance: Canterbury Lifts is committed to maintaining a safe working
environment and will comply with all relevant health and safety legislation.
6.2 Client Obligations: The Client must ensure that the site is safe for our
employees and subcontractors and must notify us of any known hazards or
risks.


7. Warranties and Liability
7.1 Workmanship Warranty: Canterbury Lifts warrants that all services will
be performed with reasonable skill and care. This warranty is valid for 12
months from the date of completion on installations.
7.2 Liability: Canterbury Lifts' liability for any claims arising from the
provision of services is limited to the value of the contract. We are not liable
for any indirect or consequential losses.


8. Confidentiality
8.1 Confidential Information: Both parties agree to keep confidential any
information that is not in the public domain and is disclosed by the other party
in connection with the services.
8.2 Use of Information: Confidential information may only be used for the
purposes of performing the services and must not be disclosed to any third
party without the prior written consent of the disclosing party.

 

9. Termination
9.1 Termination by Client: The Client may terminate the contract by
providing 30 days' written notice. The Client will be responsible for payment of
all work completed up to the date of termination.
9.2 Termination by Canterbury Lifts: Canterbury Lifts may terminate the
contract if the Client breaches any material term of the agreement and fails to
remedy the breach within 14 days of notice.

 

10. Force Majeure
Canterbury Lifts is not liable for any failure to perform its obligations due to
circumstances beyond its reasonable control, including but not limited to
natural disasters, strikes, lockouts, and other industrial disputes.

 

11. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with
the laws of England and Wales. Any disputes arising under or in connection
with these Terms and Conditions shall be subject to the exclusive jurisdiction of
the courts of England and Wales.


12. Amendments
Canterbury Lifts reserves the right to amend these Terms and Conditions at
any time. Clients will be notified of any changes, and continued use of our
services will be deemed acceptance of the amended terms.


13. Entire Agreement
These Terms and Conditions, together with any service contract or project
agreement, constitute the entire agreement between Canterbury Lifts and the
Client and supersede all prior agreements, understandings, and
representations.
